Guiding You Ltd – Terms and Conditions of Tour Contracts

Fees

Fees are as published or as contained in a quotation.

A Fee Supplement will apply for Annual Public Holidays which include 25 December, 26 December & 1 January, Good Friday, Easter Day, Easter Monday. The supplement will be in line with the current Scale of Fees published by: For Driver Guided Tours the Driver Guides Association, and for coach and walking tours: the British Guild of Tourist Guides.

Confirmation of services

A 10% deposit confirms a request for a booking which, once confirmed by the company, will create a contract between the client and the company. The balance is due by 14 days before the first booked touring date.

The Company reserves the right to add interest at the rate of 2% compound interest per calendar month, if payment remains outstanding on or after the date on which the service is provided.

Cancellation

If a confirmed booking is cancelled, the following charges, plus any unrecoverable expenditure (e.g. pre-booked hotels or tickets) will apply:

  • At any time: loss of 10% deposit.
  • 14 days – 7 days notice: 50% of the total fee
  • 6 days notice or less: 100% of the total fee.

In the event of your Guide considering that a tour should not, because of concerns for safety or client security, be attempted or continued, for example because of unexpected extreme weather, earth slip, dangerous structures etc., and there is no mutually agreeable alternative route or tour, you will, on request, receive a pro rata refund for any monies paid for guide services.

By the Company: In the event of any emergency, riot, civil commotion, strike, lock out, stoppage or restraint of labour or on the happening of any event over which the Company has no control (including adverse weather and road conditions) or in the event of the Hirer taking any action to vary agreed conditions unilaterally, the Company may, by returning all money paid and without further or other liability, cancel the contract.

Liability for injury or loss

Guiding You Ltd strongly recommends that all clients have suitable personal travel insurance to cover any losses that may arise from cancellations or other reasons

Guiding You Ltd cancellation policy will not be varied to accommodate clients who cancel a tour(s) because of any condition arising outside the UK. Such costs should be recovered from clients’ Travel Insurer.

Guiding You Ltd cannot be held responsible for the consequences of cancellations due to unscheduled closures by third party suppliers, venues, attractions or events beyond its control, but it will take all possible steps to offer an alternative.

Blue and Green badge Guides, Blue Badge Driver Guides and coaches contracted by Guiding You Ltd are covered by their own public liability insurance. Driver Guide vehicles are all insured for private hire (known as hire and reward) use and they hold driver and vehicle licences as required by their local public authority. Guiding You Ltd cannot be held liable for any loss, accident, injury or damage to clients and their personal property and effects.

Children

Children under 17 must be accompanied by a responsible adult at all times during a tour except by prior agreement.

Seat Belts and Child Seats

UK law requires seatbelts to be worn by all occupants of a moving vehicle which includes cars and coaches. For Driver Guided tours, clients are responsible for providing an appropriate child car seat for babies and small children. With advance notice your Driver Guide may be able to supply a suitable child car seat at an extra charge.

No Smoking

UK law forbids smoking in any vehicle operated by a coach company or driver-guide.

Extending a driver guided tour

If clients wish to extend a Driver Guided tour beyond the agreed booked duration, this may be possible subject to driver or guide availability and agreement to an additional Fee.

Food & Drink

Due to the problems of spillages and odours, hot food should not be consumed inside any tour vehicle. Hot drinks may be consumed only where agreed by the vehicle driver in advance.

Problems and Complaints

Problems and complaints should be addressed firstly to the guide or driver who will, in most instances find an equitable solution. If the issue remains unresolved by the conclusion of the tour, they should be notified to the Director of Guiding You Ltd., in writing. As Guiding You Ltd operates under the law of the UK, any disputes that cannot be resolved amicably will be subject exclusively to the jurisdiction of UK courts.
